It would be unthinkable that the effect in the UK of a "unitary" patent would not survive the Brexit process (even if there needed to be some sort of conversion to a standard EP(UK) patent). However, it is most definitely a risk - especially as UK practice on "same invention" double patenting make it difficult and/or costly to put a "safety net" in place.

Hard to provide sensible advice when that risk is unquantifiable, isn't it? This is why it is such a shame that the UPP will come into force without any of this being sorted out beforehand.Proof of the puddinghttps://www.blogger.com/profile/14209291532431506713noreply@blogger.comtag:blogger.com,1999:blog-7058786915356669476.post-91752465898837427932017-03-28T10:05:38.807+01:002017-03-28T10:05:38.807+01:00Looks as if EU IPO are doing that now tooLooks as if EU IPO are doing that now tooFilemothttps://www.blogger.com/profile/15735898485265104580noreply@blogger.comtag:blogger.com,1999:blog-7058786915356669476.post-15648928255017845492017-03-28T09:26:06.812+01:002017-03-28T09:26:06.812+01:00If they did make TM21 online, which would be helpf...If they did make TM21 online, which would be helpful, it would be particularly helpful if the system automatically informed the outgoing representative by email. If they see themselves as covering the full range of IP-related work, then there should be a focus on all the areas of law that affect IP transactions, including contract, tort, insolvency, charges, tax, conflict of laws, contract drafting, etc, etc. If, however, this is not considered core to the patent attorney profession, then it need not be covered.Anonymoushttps://www.blogger.com/profile/00300143334393845897noreply@blogger.comtag:blogger.com,1999:blog-7058786915356669476.post-22392379034082493902017-03-01T18:26:05.575+00:002017-03-01T18:26:05.575+00:00I agree with you about advice on designs. This is the only reserved legal activity (as defined by LSA 2007 s.12) that we do at the moment.
